Please read these terms carefully before making a purchase. By placing an order, you agree to be bound by these conditions.
General Information
These Terms and Conditions of Sale govern all purchases made on the website of Amanaliya Art (www.amanaliya.com), operated by Amanaliya Art, Swiss-French independent artist.
By placing an order, the buyer acknowledges having read and accepted these Terms and Conditions in full.

Prices & Payment
All prices are displayed in Swiss Francs (CHF). Shipping costs are calculated separately and displayed before checkout.
Payment is processed securely via Stripe. Accepted methods include credit and debit cards (Visa, Mastercard, American Express) and other methods supported by Stripe.
An order is confirmed only upon successful payment. A confirmation email with invoice is sent to the buyer after payment.
Products & Artworks
The artworks offered for sale are original creations or fine art prints by Amanaliya Art. Each piece is described with its title, technique, dimensions, and year of creation.
While every effort is made to ensure accurate colour representation, slight variations may occur between the on-screen display and the actual artwork due to monitor settings and photographic conditions.
Once an artwork is marked as "Sold", it is no longer available for purchase. Artworks marked as "Reserved" may be subject to special arrangements — please contact us for details.
Ordering Process
In accordance with Swiss unfair competition law (LCD art. 3 al. 1 let. s), Amanaliya Art undertakes to:
- Clearly disclose her identity and contact details including email address
- Describe the technical steps leading to the conclusion of a contract
- Provide tools allowing detection and correction of input errors before submitting an order
- Confirm the order by email without delay
Shipping & Delivery
Artworks are shipped worldwide from Switzerland. Shipping rates depend on the destination:
- Switzerland: 0 CHF
- Europe: 0 CHF
- USA: 120 CHF (small format) / 140 CHF (large format)
- Australia: 125 CHF (small format) / 150 CHF (large format)
Free pickup is available in Lausanne (Switzerland) and Montélimar (France).
All shipments include tracking. Original artworks are shipped with signature confirmation. Estimated delivery times are indicative and may vary depending on customs processing.
Sales are Final — No Returns
All sales of original artworks are final and binding upon payment confirmation.
Given the unique, one-of-a-kind nature of each artwork, no return or refund is offered once the order is confirmed and payment received. This policy is fully compliant with Swiss law, which does not impose a statutory right of withdrawal for online sales of original artworks (CO art. 184 ff.).
For commissioned artworks, a 50% deposit is required to begin creation. Should the buyer cancel after payment of the deposit, the deposit is non-refundable but may be applied as credit toward any other purchase on the website.
For buyers residing in the European Union: EU consumer law (Directive 2011/83/EU art. 16c) provides that the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised. Original artworks fall within this exception.
Exception — Transit damage: If an artwork arrives visibly damaged due to transit, the buyer must notify Amanaliya Art by email at studio@amanaliya.com within 48 hours of receipt, with supporting photographs. Amanaliya Art will assess the situation and propose an appropriate remedy on a case-by-case basis.

Intellectual Property
All artworks, images, texts, and content on this website are the exclusive property of Amanaliya Art and are protected under Swiss copyright law (CopA) and applicable intellectual property laws.
The purchase of an artwork grants the buyer ownership of the physical piece only. It does not transfer any reproduction, distribution, or commercial exploitation rights. Any use of images without prior written consent is strictly prohibited.
Liability & Disputes
The seller shall not be held liable for any delay or failure in delivery caused by events beyond reasonable control, including natural disasters, strikes, or customs delays.
Any dispute arising from these Terms and Conditions shall be governed by Swiss law. The parties agree to seek amicable resolution before any legal proceedings. In the absence of agreement, the competent courts of the Canton of Vaud (Lausanne, Switzerland) shall have exclusive jurisdiction.
Personal Data & Privacy
Personal data collected during the ordering process is used solely for order processing, delivery, and purchase-related communication. Data is processed securely and is not shared with third parties except as necessary for payment processing (Stripe) and shipping.
